Terms & Conditions Agreement

BY PURCHASING FROM either Dr. Morgan MacDermott NMD or Milk Medicine LLC and www.milkmedicine.com (“We” or “Company”), YOU ARE CONSENTING TO THESE TERMS & CONDITIONS. Milk Medicine LLC and Dr. Morgan MacDermott NMD reserves the right to refuse service to anyone for any reason at any time.

You understand that your information (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Payment and credit card information are always encrypted during transfer over networks.

You expressly agree not to sell, resell, reproduce, duplicate, copy, or exploit any portion of this Program, the Service provided, the Materials and Products provided, use of the Service/Products, or access to the Service/Products, without express written permission by us.

1. Account Creation. In order to gain access to any course or program or offering, you may be required to provide information about yourself, including your name, email address, username, password, and other personal information. You agree that any registration information you give to Milk Medicine LLC will always be accurate, correct, and up-to-date. Your account must not be used for any illegal or unauthorized purpose. In the event that your account is compromised, you agree to notify us in writing immediately and change your password.

2. Lawful Purposes. You may use the materials provided and/or the Service for lawful purposes only. You shall not post or transmit through our platform any material that violates or infringes the rights of others or which is racist, unethical, threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable. You may not distribute the materials as your own, as the intellectual property belongs to Dr. Morgan MacDermott NMD and/or Milk Medicine LLC. Doing so is grounds for termination of service, at our discretion.

3. Purchase Confirmation. You will receive a receipt of payment from the designated payment processor. We will also email you with details concerning access to Milk Medicine LLC’s programs. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible, at hello@milkmedicine.com.

4. Intellectual Property. This Program contains intellectual property owned by Milk Medicine LLC, including, but not limited to, trademarks, copyrights, proprietary information, and other intellectual property, as well as the Milk Medicine LLC name, logo, all designs, content, downloadables, text, graphics, digital products, other files, and the selection and arrangement of such. You will be prosecuted if you are found to have copied or resold this information and property, or are acting as either Dr. Morgan MacDermott NMD and/or Milk Medicine LLC.

(a) No Resale of Services Permitted. You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes any portion of the Program and/or products purchased via the Platform (including training materials), use of the purchased materials/products, or access to any course or products purchased. This agreement and all product(s) purchased are not transferable or assignable without the Company’s prior written consent.

(b) You agree not to share access to the Program, digital product(s) purchased or provided, or other proprietary materials with others. This includes parties that have not purchased the Program or any other third party that the Company has not authorized access to.

5. Client Duties, Cancellation, and Refunds.

(a) Compensation. Client agrees to pay the current program fee at the time of joining. If you select an auto-draft option, you understand that you will not receive an invoice reminder for these payments. Otherwise, you will receive an invoice via email and will be responsible for submitting payment by the due date stated.

(b) Refund Policy. Due to the nature of the services provided, no refunds can be provided.

(c) Customer behavior. In the event that the Customer/Client engages in abusive or unprofessional behavior in the Program, towards representatives of Milk Medicine or other members, Dr. Morgan MacDermott NMD and/or Milk Medicine LLC reserves the right to cancel the Client’s membership and terminate access to the Services, without notice. No refund will be provided in the event that this takes place. The Client will remain obligated to pay all remaining unpaid program fees in full.

6. Medical Disclaimer.

Dr. Morgan MacDermott, NMD, is a licensed naturopathic medical doctor in Idaho. However, by purchasing from and participating in programs offered by Milk Medicine LLC, you acknowledge and agree that:

(a) Not Your Doctor. While Dr. Morgan MacDermott, NMD, is a doctor, she is not YOUR doctor. The information and guidance provided in these programs do not constitute a doctor-patient relationship.

(b) No Medical Advice. The content provided through Milk Medicine LLC, including but not limited to online programs, courses, digital materials, and live trainings, is for educational and informational purposes only. It should not be interpreted as medical advice, diagnosis, or treatment. You should always seek professional medical advice from your healthcare provider before making any health decisions for yourself or your baby.

(c) Release of Liability. By participating in Milk Medicine LLC’s programs, you release Milk Medicine LLC and Dr. Morgan MacDermott, NMD, from any liability arising from health changes, decisions, or outcomes based on the information provided. Any actions you take regarding your health or your baby’s health are solely your responsibility.

7. No Guarantee of Results.

(a) Results Not Guaranteed. Milk Medicine LLC makes no guarantees about the results or outcomes of participating in its programs. Success in these programs depends on various factors, including the participant’s commitment, effort, and individual circumstances.

(b) No Financial, Legal, or Medical Advice. The information provided through Milk Medicine LLC’s services is not intended as, and should not be construed as, financial, legal, or medical advice. Participants should seek professional advice from qualified practitioners in these fields if needed.

By enrolling in Milk Medicine LLC’s online programs or live trainings, you affirm that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree with these terms, please refrain from participating in our programs.
